These Terms govern access to the SmirkDuel website, accounts, community submissions, rankings and game services.

1. Who operates the service
SmirkDuel is currently presented by SmirkDuel, an independent game project operated from Hungary. Legal notices may be sent to legal@smirkduel.com. Operator address: Hungary.
2. Acceptance and scope
By accessing the site, creating or using a SmirkDuel account, joining an Online Battle, appearing on the leaderboard, or submitting content, you agree to these Terms and any rules shown in the relevant feature. If you do not agree, do not use that feature.
Additional store, payment, tournament or promotional terms may apply if those features are introduced. Mandatory consumer rights always remain unaffected.
3. Age and parental responsibility
You may browse the public website without an account. To create or use an account, participate in account-linked features, or upload community content in Hungary, you must be at least 16 years old, or have valid authorisation from a parent or legal guardian where permitted by law. A parent or guardian who authorises use is responsible for supervising the minor's activity and understanding these Terms.
4. Accounts and security
Provide accurate information and use only accounts you are authorised to use.
Keep your device, Google account and authentication tokens secure.
Do not sell, transfer, automate, scrape or impersonate another account.
Notify us promptly if you believe an account has been compromised.
We may require re-authentication, revoke tokens, restrict access or suspend an account to protect users, investigate abuse, comply with law or preserve service integrity.
5. Gameplay, rankings and fair play
SmirkDuel is an entertainment game. Camera and facial-expression signals may be used to determine in-game events, but they are not intended for identity verification or medical assessment. Rankings may use server-verified match results, rating calculations, wins, losses and anti-duplicate controls.
Do not manipulate clients, match results, network traffic, cameras or detection systems.
Do not coordinate fake matches, exploit bugs or harass opponents.
Leaderboard results may be corrected, reset or removed where fraud, error or abuse is reasonably suspected.
6. Community submissions
You retain ownership of images, videos, titles and descriptions you submit. By submitting content, you confirm that you created it or hold all permissions needed for us to use it.
You grant SmirkDuel a non-exclusive, worldwide, royalty-free licence to host, copy, transcode, moderate, adapt for technical formatting, display, distribute and make the content available inside the game, website and official SmirkDuel promotional channels. This licence exists only to operate, improve and promote SmirkDuel and may be sublicensed to technical service providers for those purposes.
You may request removal of unpublished or published content. Removal will be handled within a reasonable period, subject to backups, legal obligations, dispute evidence and content already incorporated into materials that cannot reasonably be recalled.
7. Prohibited content and conduct
Do not upload or distribute content that:
is illegal, fraudulent, threatening, hateful, sexually exploitative, excessively violent or designed to facilitate harm;
infringes copyright, trademark, privacy, publicity or other rights;
depicts a person without the permissions reasonably required for publication;
contains malware, hidden tracking, deceptive links or manipulated files intended to attack the service;
targets minors, reveals sensitive personal information, or encourages harassment or dangerous challenges;
misrepresents sponsorship, endorsement, identity or source.
Moderation approval is discretionary and does not certify legality, ownership, accuracy or safety. We may reject, age-restrict, unpublish or remove content at any time.
8. Intellectual property
The SmirkDuel name, logos, visual identity, software, interface, game rules implementation, artwork and original content are owned by or licensed to the operator. You may not copy, reverse engineer, resell or commercially exploit them except where applicable law expressly permits.
9. Third-party services
The service may rely on Google Sign-In, app stores, hosting, content delivery and network providers. Their own terms and privacy notices apply to their services. We are not responsible for third-party products or outages outside our reasonable control.
10. Availability and changes
The service is under active development. Features may change, be interrupted, reset or discontinued. We do not guarantee uninterrupted availability, permanent rankings, continued publication of any submission, or compatibility with every device.
11. Disclaimers and liability
To the maximum extent permitted by law, the service is provided on an “as available” basis. We do not exclude liability that cannot legally be excluded, including liability for intentional misconduct, gross negligence, personal injury caused by our fault, or mandatory consumer protections. Otherwise, we are not liable for indirect or unforeseeable loss, lost opportunities, lost data caused by user devices, third-party failures or misuse of the service.
12. Termination
You may stop using the service at any time and may request account deletion. We may restrict or terminate access for material or repeated violations, security risks, legal requirements or discontinuation of the service. Provisions concerning licences, intellectual property, disputes and liability survive where their nature requires.
13. Governing law and disputes
These Terms are governed by Hungarian law, without depriving consumers of mandatory protections available in their country of residence. Before starting formal proceedings, please contact legal@smirkduel.com so we can try to resolve the issue.
14. Changes to these Terms
We may update these Terms when the service, law or our operational practices change. Material changes will be highlighted through the website or app. The effective date and version at the top identify the current document.

1. Controller and contact

2. Data we may process
Account data
Internal user ID, username, Google account identifier used for linking, authentication status and account settings.
Device and security data
Random web device ID, authentication tokens, IP address, user agent, timestamps, request IDs, logs and anti-abuse signals.
Gameplay and ranking data
Room and match metadata, role, result, rating, wins, losses, win rate, leaderboard position and integrity checks.
Camera and live-play data
Camera frames and facial-expression signals used for gameplay. They are not intended for biometric identification. Online video may be transmitted in real time to the opponent.
Community content
Uploaded image or video, title, description, category, age rating, rights confirmations, moderation status and reviewer notes.
Support and legal data
Messages, reports, rights requests and evidence needed to resolve disputes, enforce rules or comply with law.

4. Camera and facial-expression processing
The game may analyse face landmarks, visibility and smile-related signals to run rounds and display warnings. The purpose is gameplay, not identifying who you are. Where technically applicable, analysis occurs on the device. In Online Battle, live video may be sent through a real-time peer connection to the opponent, while signaling services help establish and maintain the connection. SmirkDuel does not intend to store live camera streams unless a separate capture, reporting or sharing feature is clearly activated.
Automated gameplay outcomes do not produce legal or similarly significant effects.
5. Public data
Your username and selected game statistics may be publicly visible in the Arena leaderboard. Approved community content may be published in the app, website or official promotional channels together with a username or attribution where appropriate. Do not use a username or upload content that reveals information you do not want to make public.
6. Browser storage, cookies and external resources
Session storage: the website stores the temporary submission token and username for the current browser session.
Local storage: a random web device identifier supports secure Google-linked sign-in.
Server cookies: authentication or security infrastructure may set strictly necessary cookies.
Google Identity Services: Google may receive technical request data and use its own cookies or storage when the sign-in component loads or is used.
Fonts, icons and delivery providers: external providers may receive IP address, browser and request information when resources are delivered.
This version of the landing page does not intentionally use advertising cookies or behavioural advertising analytics. If non-essential analytics or marketing technologies are introduced, this notice and any required consent controls must be updated before activation.
7. Recipients and processors
Data may be shared with staff or contractors who need access for operation, moderation, security or support; hosting, storage, networking and content-delivery providers; Google for identity services; app-store providers; professional advisers; and public authorities where legally required. Providers are given only the access reasonably needed for their role.
8. International transfers
Some providers may process data outside the European Economic Area. Where required, transfers are protected by an adequacy decision, approved Standard Contractual Clauses or another lawful safeguard, together with supplementary measures where appropriate.
9. Retention
We keep personal data only for as long as necessary for the purpose collected. Retention depends on account status, token expiry, moderation and appeal needs, leaderboard integrity, security investigations, legal claims, statutory requirements and backup cycles. Data may be anonymised instead of deleted where individual identification is no longer needed. Legal holds or active disputes may require longer retention.
10. Security
We use measures appropriate to the nature of the service, including encrypted transport, access controls, token-based authentication, restricted administrative access, logging, moderation and backups. No online system can guarantee absolute security. Do not send passwords, full identity documents or authentication tokens by ordinary email unless we specifically request a secure verification method.
11. Children
Children deserve heightened protection. In Hungary, a child below 16 cannot independently give consent for consent-based online-service processing; valid parental or guardian authorisation may be required. Account-linked and upload features are not intended for unsupervised use by children below that age.
12. Your rights
Depending on the circumstances, you may have rights of information, access, correction, deletion, restriction, portability, objection, withdrawal of consent and complaint to a supervisory authority. Open the tab for the request process and limitations.
13. Changes
We may update this notice when the service, providers, data practices or law change. Material changes will be highlighted through the website or app. The version and effective date at the top identify the current notice.

Include your SmirkDuel username, the Google-linked email address if relevant, and the right you want to exercise. Do not send passwords or tokens.

Verification
We may ask you to re-authenticate or provide limited additional information when reasonably necessary to prevent disclosure to the wrong person.

Response
We normally respond without undue delay and within one month. Complex or numerous requests may require an extension permitted by law, and we will explain it.
2. Important limits
Rights are not absolute. A request may be limited where processing is necessary for legal obligations, freedom of expression, security, fraud prevention, leaderboard integrity, legal claims or the rights of others. We will explain any refusal or limitation. Requests are normally free, but a reasonable fee or refusal may be permitted for manifestly unfounded or excessive requests.
3. Account and content deletion
Deleting an account may remove or anonymise profile and ranking data, revoke active tokens and remove unpublished submissions. Published content may require a separate removal assessment because of licences, third-party rights, legal claims, backups or materials already distributed. We will not keep data identifiable merely because it may be useful someday.
4. Objection and legitimate interests
You may object to processing based on legitimate interests for reasons relating to your particular situation. We will stop unless we demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing is needed for legal claims. Direct marketing objections are honoured without balancing.
5. Complaint and court remedy
You may lodge a complaint with the supervisory authority in your habitual residence, place of work or place of the alleged infringement. You also retain the right to seek a judicial remedy.
